CMS Releases SNF and IRF Final Rules

Late last month, the Centers for Medicare & Medicaid Services (CMS) released the Fiscal Year 2024 Skilled Nursing Facility and Inpatient Rehabilitation Facility Prospective Payment System Final Rules.  The rules finalize payment for SNF and IRF effective October 1, 2023.  Your Academy submitted comments on the proposed rules for IRF and SNF in June.

Our comments regarding the IRF rule specifically requested an extension or implement of a permanent waiver to the “three-hour rule,” which has been an advocacy priority for the Academy.  CMS did not take action on this in the final rule.  The Academy’s additional comments on both the SNF and IRF rules related to quality reporting proposals. AAPM&R supported removal of several measures in the SNF and IRF Quality Reporting Programs.  Additionally, the Academy responded to a request for information in both rules related to measurement tied to health equity and assessment of social determinants of health.

Legislation Introduced to Alleviate Impact of Conversion Factor Cut for 2021

Last month, two bills were introduced in the House proposing solutions to the estimated 10.6% Physician Fee Schedule conversion factor cut expected to go into effect January 1, 2021.  The bills offer some relief to the cut, but do not reflect a comprehensive or long-term solution.  AAPM&R has therefore chosen to remain neutral regarding these bills. 

Your Academy continues to advocate for a permanent solution to the conversion factor cut while maintaining the important payment increases to office and outpatient evaluation and management services.
